Meeting Minutes
A. Call to Order
Matt Ellis called the meeting to order at 7:32 p.m.

PZC2009-13
Application for modification of Special Permit to add propane pump station at 331 River Road (Map 30 Lot 16 Zone DC) Applicant: Jerry Johnston (Received May 19, 2009 Public Hearing or Decision by July 21, 2009)
M. Ellis told the commission, if they deem this to be a minor modification to the plan, the application does not have to go to public hearing.
The applicant said the plan is to put a propane filling station behind the building on the outside. Mr. Johnston said it would be a 500 gallon tank. J. Poole asked why the change. Mr. Johnston said it would be a good way to get people to come thru his business. G. Jones asked if the plan had been run by the Fire Marshal. Mr. Johnston said yes, when he came out to inspect the building he had asked him about it. A letter was submitted, from the Fire Marshal, stating he does not have a problem with this but he would have to inspect once completed.
J. Poole asked if the applicant would take tanks in that are not longer valid and the applicant said no. He also commented that the filling station hours would be the same as the store hours and that no tanks are to be brought inside. There will be a sign on the door stating this. Paul Smith was also present and will supply the propane to the applicant. He said 20lb ABC fire extinguishers will be at the location.
A discussion was held on whether or not this application should go to public hearing. J. Poole expressed his concern and would like it to go to public hearing to inform the daycare and other neighbors of the plans. The other commission members did not feel it should go to public hearing but would like to notify the daycare. G. Jones said the applicant could send a letter to the daycare.
E. Standish motioned to approve the application as it is a minor modification and on the following conditions. Fire Marshal approval is to be received prior to any distribution of propane and the applicant is to send a letter of notification to the daycare. T. Murphy seconded the motion. J. Poole said, in the future, he would like to encourage an applicant to supply all the information, up front, with the initial application. All in favor. Motion carried.
PZC2009-9 Application for modification of Special Permit to allow for concession sales use at 511 River Road (Map 39 Lot 6 Zone DR) Owner/Applicant: Town Of Willington (Received May 10, 2009 Public Hearing or Decision by July 21, 2009)
G. Jones said the applicant would like to sell concessions out of the storage shed. He said they want to sell packaged food and bottled beverages. When the shed was approved the first time, the commission said it was for storage only.
J. Poole said, when the applicant came forward the first time, they were asked to inform the commission of the entire plan. He said they have not done that. A. Marco said it sounds like there is a plan and asked if J. Poole would like to see an updated plan in which he replied yes. G. Jones said he does not think they know what the final plan is because they don’t know what they will have for funding. G. Jones said the application is for selling concessions out of the shed. J. Poole asked if the plans show a concession stand. G. Jones said no, it shows a shed.
The application was tabled until the next meeting and the commission would like a member of the recreation department present.
J. Poole asked about the regulations that pertain to this application. P. Latinscics asked staff to review anything that would be relevant to this application.
Minutes
J. Poole motioned to approve the minutes of April 21, 2009. T. Murphy seconded the motion. All in favor.
E. Standish motioned to approve the minutes of May 5, 2009. M. Ellis seconded the motion. T. Murphy and A. Marco abstained. All others in favor.
Correspondence
1. Notice from Mansfield’s Planning and Zoning regarding proposed changes to their regulations.
2. Letter from Windham Region Council of Governments regarding the Extension of Subdivision Moratorium.
3. Letter from the University of Connecticut on the schedule for the Basic Training for local land use commissioners.
Staff Report and Discussion
G. Jones said he had nothing additional to report at this time.
A. Marco said he talked to an outside engineer on the possibility of doing a “trial run” of the proposed regulations using the Knowlton property. He said there would be a charge for this and he estimates the cost to be approximately $3000. The commission felt that to be reasonable. A discussion was held on the procedure for obtaining a Request for Proposal. Staff will look into this. G. Jones to follow up with Peter Andersen, of the Conservation Commission, on the A-2 survey.
M. Ellis said S. Yorgensen sent the proposed regulations to the fire marshal, health department, town engineer and the attorney and they hope to have the proposed regulations back to the commission, with changes and recommendations, by the end of the next week.
J. Poole expressed his concern on Ruby Road Development grinding and processing sand and gravel at all hours of the day. He said when the application was approved; hours of operation were not regulated.
G. Jones said he has looked at the contours of the land and he estimates they are taking off 2000 yards of gravel to get it where it should be and they are following the plans.
J. Poole recommended, in the future, the commission waits until the next meeting before submitting a motion to fully think through all aspects of an application. M. Ellis said, in his first few years on the commission, they never submitted a motion the day of the initial meeting.
